PowerShelter respects the safety and privacy of everyone using our lockers. This User Agreement explains the conditions under which you may use our charging and storage services.

  1. Scope of the Agreement

This Agreement applies to all riders, couriers, and other individuals (“Users”) who access or use PowerShelter lockers or related services (“Services”). PowerShelter B.V. (Chamber of Commerce 90888189), located at Jacob van Lennepkade 155H, 1054 ZL Amsterdam, the Netherlands (“PowerShelter”), operates these Services. By creating an account, entering a PIN code, storing a battery or private property, or otherwise using our lockers, you agree to this Agreement and to PowerShelter’s Privacy Policy.

  1. Use of PowerShelter Services

PowerShelter provides secure, powered compartments for charging and temporarily storing e-bike batteries or related equipment. Use of the Services may be free of charge, pay-per-use, by daily or monthly subscription, or provided through a third party. Pricing and availability may vary by location or operator. PowerShelter may modify, suspend, or discontinue Services at any time.

  1. Eligibility and Accounts

You must be at least sixteen (16) years old to use the Services. To access paid or reserved lockers, you may need to create an account or verify your identity through our app, website, or tablet interface. You are responsible for maintaining accurate information and securing your access credentials.

Accounts and access methods are personal and may not be shared, transferred, or used by anyone other than the registered User. You are fully responsible for all activity conducted through your account, PIN or RFID card, or other assigned access method, whether authorized by you or not. PowerShelter reserves the right to suspend or terminate any account or access found to be shared or misused.

  1. Approved Batteries and Chargers

In the European Union, only CE-certified batteries and chargers may be used. In the United Kingdom, only UKCA-certified equipment is permitted. In the United States and Canada, only UL- or CSA-certified equipment is permitted. Use of non-certified, damaged, or modified devices is strictly prohibited. PowerShelter may refuse or disable access for Users found to be using unsafe or non-compliant equipment.

  1. Charging and Safety

When using the lockers, you must follow the manufacturer’s charging instructions for your specific battery and charger. Do not store or charge flammable materials, liquids, or unrelated items. Ensure cables are intact and properly connected. PowerShelter units are designed as passive, electrically supplied enclosures. Any incident caused by improper use, defective batteries, or non-compliant chargers remains the User’s responsibility. This limitation does not apply where damage results directly from a defect in the PowerShelter locker itself. In the event of smoke, excessive heat, or other hazard, disconnect power if safe to do so and notify emergency services or the host location immediately. 

6. Payments and Pricing

When applicable, fees for locker use are displayed in the app, on-site, or on the relevant payment screen. Payments are due immediately upon termination of the full charging period, unless otherwise specified. PowerPowerShelter may adjust or update fees, currencies, or payment methods at any time, but any changes will apply only to future sessions and will be clearly displayed before you confirm use. All displayed prices include VAT and applicable taxes unless otherwise stated. 

For pay-per-use sessions, the service is performed immediately upon confirmation and you acknowledge that the statutory right of withdrawal does not apply. For subscription-based services, you may withdraw within fourteen (14) days of purchase unless you have already begun using the service.

If a locker or application malfunctions, or if charging cannot be completed, please contact support@powershelter.com or call +31 8 5060 6350 within fourteen (14) days for review and possible refund. Refunds will be assessed based on usage data and service records.

7. Liability and Disclaimer

The battery and any items placed in a locker remain the property and responsibility of the User. PowerShelter is not responsible for any loss, theft, or damage to property, including batteries, chargers, or bicycles. PowerShelter provides the lockers “as is” and makes no warranties regarding continuous availability, complete safety, or suitability for a particular purpose. PowerShelter is not an insurer and assumes no liability for fire, damage, or injury resulting from misuse, defective batteries, or user negligence. To the fullest extent permitted by Dutch law, PowerShelter’s total liability shall not exceed the total fees paid by the User for the session or period in question.

8. User Responsibilities

Users must use the lockers responsibly and in accordance with all posted instructions. You are responsible for any damage or disturbance caused at the host location where a PowerShelter unit is installed. You may not tamper with, modify, or damage any PowerShelter hardware or software.

9. Termination and Suspension

PowerShelter may suspend or terminate your access immediately if you violate this Agreement, misuse the lockers, or pose a safety risk. PowerShelter may also terminate or discontinue any private or subscription agreements due to changes in its commercial structure, product offerings, or operational capacity. In the event PowerShelter discontinues a service or subscription, fourteen (14) days notice will be provided and any prepaid but unused amounts will be refunded. You may terminate your account at any time, but outstanding fees remain payable. 

10. Third-Party Operators

Some lockers are managed by third-party partners, such as employers, municipalities, or service providers. PowerShelter is not responsible for the actions or conditions of such third parties. Their additional terms may apply.

11. Data and Privacy

Your personal data is processed in accordance with the PowerShelter Privacy Policy, available at https://powershelter.com/nl/legal/privacy-policy. PowerShelter processes your data as necessary to perform the service, fulfill legal obligations, and pursue its legitimate interests. By using the Services, you consent to the collection and processing of your data as described in our policy. 

12. Governing Law and Disputes

This Agreement is governed by the laws of the Kingdom of the Netherlands. PowerShelter and the User shall first attempt to resolve any dispute amicably. If unresolved, the courts of Amsterdam shall have exclusive jurisdiction. Consumers residing in the European Union or United Kingdom may also bring proceedings in their country of residence if required by applicable consumer law.
